Detailed below are some of the regulation changes we are aware of. These are updated as more information becomes available

AEO - End of the two year transitional period and changes to the time limits for HMRC to issue a decision

The two year transitional period for AEO ends on 31 December 2009. From 1 January 2010 new time limits will apply for HMRC to issue a decision on an AEO application. At the General Legislation Meeting on 26 October it was agreed the new time limit should be set at 120 calendar days, from the date of receipt of all the complete information. This period can be extended by HMRC by a further period of 60 calendar days in duly justified circumstances, for example where the application is complex and requires an examination of the AEO criteria at a number of different sites.

Dangerous Goods Notes

The new rules for completion of Dangerous Goods Notes come into force on 1st January 2010.

New versions of the pre-printed stationery are now available as 2009 version which replaces the 1999 version.  These include changes to the text on the front and reverse of the form. 

i2i customers have been upgraded with the latest data changes which are required to complete the DGN.

Latest News - August 2009

The latest update to the GTA Online service included the following changes specifiatlly to meet the new ECS requirements:

  • NEW - UNDG code added to allow the UN Dangerous Goods code to be quoted in ECS submissions
  • NEW - EAD Document with bar code which replaces the SAD Copy 3 for certain exports

Electronic Tariff - HMRC

CHANGES TO THE ELECTRONIC TARIFF SPECIFICATION
Further to the note issued by HMRC in early October 2009, relating to the change from numeric to alphanumeric for the Commodity Additional code field, due for implementation in 2010.
  • The Commission have now decided to delay the implementation of this data and at present no new release date has been given
  • The reason for delay is due to technical problems
  • Due to this information and the fact that further changes may occur HMRC feels that it would be prudent at this stage not to release a test file
  • Until further information is received the continued use of numeric codes will apply.
  • Once additional information is received an updated Electronic Tariff file specification will be produced along with an explanatory note

EMCS (Export Movement and Control System)

HMRC have today announced that they will be holding a number of events throughout the UK where they will demonstrate the new EMCS system and take questions on how the EMCS applications will operate within your business.   These event are aimed at organisations who will be keying data directly into the HMRC online system.  Events will be held as follows:

16th March - London
17th March - Birmingham
23rd March - Glasgow
24th March - York
30th March - Belfast.

Intrastat & VAT

HMRC are reminding exporters that they should check the Commodity Codes they are using to make sure they are correct.  Every year a proportion of these codes are amended and you need to make sure you are using the correct ones.   There is a penalty of up to £2,500 per offence for reporting incorrect Commodity Codes on your Intrastat Suplementary Declaration (SD).

CIP 51 - New data element required on CHIEF from 1st January 2010

SAD Box 22 - Currency of Invoice for trade will be mandatory from 1st January 2010, but only for  declarations above a statistical value in the region of £100,000 (yet to be set).    There will be no requirement for the actual invoice value, or to change the currency in which the statistical value (Box 46) is declared. 

Most i2i customers will already have this data element added to their systems so that this requirement is ready to implement in January.

US Importer Security Filing (10+2 Rule)

10+2 Rule

10  =  US Importer Security Filing requires importers to electronically transmit 10 data elements to Customs Border Protection (CBP), 24 hours before loading any container onto a ship bound for the US.

2  =  2 data files need to be submitted to CBP by the ocean carrier.
